Google refuses EU's mandatory fact-checking rules for search and YouTube, citing inefficiency. It prefers existing measures for content moderation and user tools.
The European Union introduced the Code of Practice on Disinformation in 2022. This code encourages tech platforms to combat misinformation voluntarily. The EU aims to make this mandatory under the Digital Services Act (DSA). Google, Meta, and others cooperated previously but expressed concerns about stricter enforcement. For Google, taking responsibility for misinformation in European elections has been a growing issue.
On January 18, 2025, Google clarified its position to the EU Commission via a letter. Kent Walker, Google’s Global Affairs President, called the code “not appropriate or effective” for their services. Axios revealed the letter, which emphasized Google’s unwillingness to conduct fact-checking directly or integrate them deeply into its algorithms. Currently, Google includes third-party fact checks in rare cases.
Google referred to its current moderation methods as sufficient. During global elections in 2024, these included YouTube’s contextual annotations and AI tools. Walker highlighted Synth ID watermarks and AI verification as successful features. He noted their potential for combating disinformation. YouTube also allows users to make annotations, which Google sees as an effective community tool.
Walker confirmed Google would step back from obligations under the Code of Practice before it integrates into the DSA. If companies violate the DSA, the EU can impose significant sanctions. Despite its refusal, Google intends to improve existing moderation methods and invest in user education tools. However, this decision raises concerns about tech giants’ roles in combating misinformation.
