India's Competition Commission (CCI) found Amazon and Flipkart guilty of violating competition laws by favoring specific sellers. This investigation comes as quick commerce challenges their dominance in India's $50B e-commerce market.
In 2020, India's Competition Commission (CCI) began investigating Flipkart and Amazon India. The inquiry was spurred by complaints from a group of physical store owners. These retailers argued that the two e-commerce giants were skewing the market by giving certain sellers priority in product listings, particularly for mobile phones. According to Reuters, the investigation concluded that this preferential treatment made ordinary sellers "mere database entries" and stifled fair competition.
The CCI's findings, which Reuters reports to be confidential, confirmed that the companies used anti-competitive practices to boost favored sellers. These preferred sellers not only received better placement in search results but also benefited from reduced fees. In sectors like mobile phones, these strategies had a "catastrophic impact" on competition. This investigation represents a major setback for Amazon and Flipkart as they battle for dominance in India’s fast-growing e-commerce market.
Despite the CCI's findings, Amazon and Flipkart still dominate India's e-commerce market, which clocked an estimated $50B to $60B in sales in 2023. However, quick commerce companies like BlinkIt, Zepto, and Swiggy’s Instamart are rapidly gaining traction. These firms are projected to generate $6B in GMV (gross merchandise value) annually. Their swift delivery models have started eating into the market share of Amazon India and Flipkart, especially in the urban sector.
As the competition heats up, both Amazon and Flipkart have invested heavily in India, pouring over $25B into infrastructure to secure their place in the market. However, regulatory scrutiny could pose long-term challenges. The report highlights growing concerns over the e-commerce giants’ impact on small retailers. These developments may push Indian authorities to enforce stricter competition laws to ensure a level playing field in the country’s retail market.
